Terms of Service

By accessing or using Nestling ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Nestling is a local marketplace that connects buyers and sellers of second-hand baby and children's gear. We facilitate discovery and communication between users but are not a party to any transaction between them.

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration.

Sellers are solely responsible for the accuracy and legality of their listings. By posting a listing, you represent that:

• You own the item or have the right to sell it.
• The item is accurately described, including any defects.
• The item complies with all applicable safety standards.
• The item has not been subject to a safety recall (check CPSC.gov).

The following items are prohibited: car seats that have been in a crash, items exceeding their manufacturer expiration date, cribs that do not meet current federal safety standards, items subject to an open safety recall, and any item that is illegal to sell.

We reserve the right to remove any listing at our discretion.

Transactions are directly between buyers and sellers. Nestling is not a party to any sale. Payment processing is handled by Stripe. Nestling charges a 1% platform fee on completed transactions.

All sales are final unless the buyer and seller agree otherwise. We strongly encourage buyers to inspect items before completing payment confirmation. Nestling does not mediate disputes, but we may assist in good faith where possible.

You agree not to:

• Post false, misleading, or fraudulent listings or communications.
• Harass, threaten, or abuse other users.
• Use the Service for any unlawful purpose.
• Attempt to circumvent or manipulate platform fees.
• Scrape, crawl, or systematically extract data from the Service.
• Impersonate any person or entity.

You retain ownership of content you post. By posting content, you grant Nestling a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating the Service.

The Nestling name, logo, and original platform content are our intellectual property and may not be used without prior written permission.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no representations about the quality, safety, or legality of listed items.

To the fullest extent permitted by law, Nestling and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to disputes between buyers and sellers, personal injury, or property damage from items purchased through the platform.

Our total liability to you for any claim shall not exceed the fees paid by you to Nestling in the twelve months preceding the claim.

You agree to indemnify and hold harmless Nestling and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your listings, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.
